Welcome to Qugo. These Terms of Service ("Terms") govern your access to and use of the Qugo mobile application ("QugoApp"). By creating an account or using our services, you agree to be bound by these Terms.
1. Non-Custodial Interface & Liquidity Aggregation
Qugo acts strictly as a non-custodial software user interface and liquidity aggregator. QugoApp allows users to interact directly with digital assets, execute peer-to-peer swaps, and direct liquidity payouts.
Interface Limitation: Qugo does not custody, manage, or hold client digital assets or fiat deposits. We provide the technology that routes orders to external clearing systems and decentralized liquidity pools. You retain sole responsibility for securing your wallet keys and access credentials.
2. Dependency on Third-Party Partners
Our services rely on integrations with third-party financial service providers, licensed clearing networks, and payment channels:
- Asset Swaps & Clearing: Digital asset custody, currency exchanges, and clearing operations are facilitated by Quidax and other partner liquidity networks. By using these features, you agree to be bound by the respective terms of service of these providers.
- Fiat Settlement & Bank Rails: Payout operations to Nigerian bank accounts are processed via licensed payment gateway networks, primarily Paystack. All local bank payouts are subject to Paystack's settlement terms and bank uptime rules.
3. User Account Security
You are solely responsible for maintaining the confidentiality of your account credentials, security PINs, and local device access. You agree to notify us immediately of any unauthorized use of your account. Qugo shall not be held liable for losses arising from compromised devices or stolen credentials.
4. Prohibited Activities
You agree not to use QugoApp for any unlawful activities, including but not limited to money laundering, terrorist financing, fraud, cyberattacks, or trading restricted assets. Any suspicious activities will result in immediate account suspension and disclosure to regulatory authorities.
5. Limitation of Liability
Qugo provides its services on an "as is" and "as available" basis. We make no representations or warranties regarding service uptime, network delays, or the operations of our third-party partners (including Quidax and Paystack). To the maximum extent permitted by law, Qugo shall not be liable for any indirect, incidental, or consequential damages.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to conflict of law principles.
